Banking Disputes in Iraq: Preparing the Case and the Evidence

Banking disputes in Baghdad can arise from lending, guarantees, security, account operations or contested transactions. The first task is to identify the precise obligation in dispute. A complaint about a payment, for example, may involve the account contract, authentication records and the actions of more than one institution.

Reconstruct what happened

Create a chronology supported by original records. Collect account terms, facility agreements, guarantees, transaction instructions, statements, notices and relevant correspondence. Preserve electronic records in their original form where possible, including the context needed to explain who created or approved them.

For a credit dispute, reconcile the amount claimed with disbursements, repayments, charges and any agreed amendments. For a contested transfer, identify the instruction channel, approval sequence and dates on which the issue was reported. Assertions about fraud or authorisation require evidence, not assumptions based solely on the outcome.

Examine the contract and the regulatory setting

Banking litigation in Iraq may involve contractual questions alongside the banking regulatory framework. The Banking Law is a starting point for understanding the institution’s legal setting, but the available claim and procedure depend on the specific facts and documents.

Review jurisdiction, any arbitration clause, notice requirements, limitation issues and the parties that should be involved. If guarantees or security are relevant, examine their wording, execution and relationship with the underlying debt. Do not assume that every group company is liable for another entity’s obligation.

Choose a recovery or resolution strategy

Assess the desired outcome: correction of an account, payment, enforcement of security, release of a guarantee or a negotiated restructuring. Consider the evidence, likely defence, available assets and commercial relationship when comparing negotiation with proceedings.

Keep communications controlled while the matter is reviewed. An informal explanation, acknowledgement or proposed settlement can affect the factual record. Urgent risks should be brought to counsel promptly so that any available protective action can be assessed.
