Patent and copyright questions in Iraq concern different kinds of assets. An invention, a software program, a technical drawing and a training manual may need different forms of protection. The first step is to identify what has been created, who created it and how the business obtained its rights.
Assess inventions before public disclosure
For patent registration in Baghdad, prepare a technical description of the invention, the inventors’ details and the proposed owner. Review eligibility, novelty-related issues and any earlier disclosures or foreign filings before choosing a filing strategy. Publicly presenting the technology before advice is obtained can complicate that assessment.
Iraq’s patent framework includes Patent and Industrial Designs Law No. 65 of 1970 and amendments reflected in WIPO Lex. The applicable text and filing route should be checked for the specific invention. A foreign patent should not be assumed to provide identical protection in Iraq.
Establish copyright ownership
Copyright law in Iraq concerns protected works and the rights associated with them. Copyright Law No. 3 of 1971 was amended, including by Order No. 83 of 2004. [2] The legal analysis should distinguish the work itself from an underlying idea, function or business concept.
For commissioned software, designs or content, review the contract with the creator. Payment for development does not remove the need to clarify ownership, permitted use, modifications and the right to license the work to others. Retain dated drafts, source files and evidence of the development process.
Connect protection with commercial use
An intellectual property licence should identify the asset, territory, permitted users, duration and restrictions. Address improvements, third-party components and the consequences of termination. Confidential information may also require access controls and contractual protection regardless of whether another intellectual property right is available.
If misuse is suspected, preserve examples, dates and source information before contacting the other party. Avoid making public accusations until ownership and the alleged conduct have been assessed.
