Property registration in Iraq should begin with the official record and the proposed buyer’s legal position. A sale agreement, possession of the site or an investment proposal does not by itself establish registered ownership. The property’s identity, title, restrictions and permitted use need to be examined together.
Verify the property and the seller
Obtain the relevant registration information and compare it with the site, boundaries and transaction documents. Confirm the registered owner and the authority of the person proposing to sell or grant rights. Identify mortgages, attachments, competing interests or other restrictions that require investigation.
The Real Estate Registration Law No. 43 of 1971 is a central reference for registration matters; current amendments and procedures should be checked for the transaction. Ministry of Justice material also records ongoing reform discussions, which should not be confused with enacted changes.
Assess foreign ownership separately
Foreign ownership of property in Iraq depends on the buyer, property and applicable legal route. Do not assume that incorporating a company or obtaining an investment licence automatically permits every land acquisition. Where an investment-based right is proposed, examine the relevant investment framework and the exact conditions attached to the project.
Land ownership in Baghdad should also be distinguished from a lease, allocation or other right to use land. The commercial value and transferability of these rights can differ substantially.
Coordinate title, use and payment
For real estate investment in Iraq, investigate the intended use, planning position, access, utilities and any development obligations. A valid title does not necessarily mean the proposed building or activity can proceed without further approvals.
Sequence the transaction so that payment, required releases and registration steps are coordinated. The agreement should address what happens if a title issue emerges or a necessary approval is not obtained. Keep a complete record of the final transfer and supporting documents.
